The main hearing chamber of the European Patent Office looked out over the grey, swelling current of the Isar River. Heavy oak paneling, strict acoustic baffling, and the formal posture of five senior European patent examiners gave the room the solemn weight of a constitutional tribunal.

Dr. Helmut Kaufmann sat at the petitioner's bench, hands flat on a thick leather dossier. Beside him, two senior patent attorneys from Munich's premier IP firm adjusted their spectacles, surrounded by stacks of technical white papers from the EUREKA 147 research initiative.

Across the aisle sat Victoria and David Hirsch. Victoria had exchanged her navy London suit for dark charcoal, posture relaxed against the hard wooden bench. Beside Hirsch sat Dr. Klaus Weber, a veteran Munich patent attorney specializing in international semiconductor litigation.

At the center of the dais, the Chairman of the EPO Technical Board of Appeal tapped his pen, calling the session to order.

"We are here to consider Petition of Opposition 89/402, filed by the Kaufmann-Bavaria Industrial Co." His English carried a formal, deliberate Bavarian cadence. "The petitioner seeks total revocation of European Patent EP-0382910, registered to Saraswati Intellectual Holdings, concerning sub-band psychoacoustic quantization for digital audio streams." He turned to Kaufmann's counsel. "Herr Dr. Lindner, you have twenty minutes to establish your claim under Article 52."

Lindner stood, adjusting his tie, and spoke with the crisp, rehearsed authority of a veteran German advocate.

"Members of the Board. Article 52, Paragraph 2 of the European Patent Convention is explicit. Schemes, rules, and methods for performing mental acts, playing games, or doing business, alongside programs for computers, are expressly excluded from patentability within all member states."

He walked to the easel, pointer resting on the BAC-1 equations.

"The patent granted to Saraswati describes a psychoacoustic sub-band quantization process. Strip away the legal verbiage, and what remains? A pure mathematical algorithm — a set of calculations for frequency masking in the human ear. Mathematical algorithms as such belong to the public domain. To allow a Caribbean entity a monopoly over basic acoustic math across Western Europe would violate the foundational principles of European patent law."

He sat, offering Kaufmann a firm nod.

"Dr. Weber, your response?"

Weber stood calmly. He didn't touch the mathematical white papers. Instead he opened a velvet-lined case on the defense table and pulled out certified circuit boards and silicon register schematics, stamped with the blue seal of the Round Rock plant and the Osaka facility.

"Mr. Chairman, members of the Board. The petitioner's argument relies on a deliberate mischaracterization of Saraswati's claims. If BAC-1 were merely a software program running on a general-purpose processor, Herr Dr. Lindner's reading of Article 52 would be accurate."

He handed the clerk a technical brief signed by Vik Malhotra and the lead silicon architects in Osaka.

"However — as demonstrated in Exhibit C — Saraswati's patent does not claim an abstract mathematical formula. It claims a specific, hardware-bound signal processing architecture." He pointed to the magnified silicon schematic. "When a BAC-1 bitstream enters a machine powered by the Bhairav-1 microprocessor, the sub-band quantization frames don't execute in standard CPU RAM. They execute directly inside dedicated DSP registers built into the physical silicon."

Victoria sat back on the bench, hands still in her lap, watching Weber run the exact technical trap drafted in Austin three days earlier.

"Under the landmark VICOM precedent established by this very Board in 1986," Weber said, not looking away from the Chairman, "a mathematical process that produces a physical, technical contribution to the operation of a hardware circuit is fully patentable. The BAC-1 instruction set causes a physical state change within the transistors of the Bhairav-1 DSP register. It is a technical contribution to semiconductor engineering, not a paper calculation."

The five examiners leaned forward, whispering over the register blueprints. Kaufmann turned to his lawyer, brow furrowed.

The Chairman raised a hand for silence and looked down at Lindner.

"Dr. Lindner. Does the Kaufmann Consortium have evidence that BAC-1 can be executed on standard European audio receivers without specialized DSP register manipulation?"

Lindner hesitated, glanced at Kaufmann. "Mr. Chairman... the processing load required for sub-band psychoacoustic quantization on standard microprocessors causes continuous instruction stalls. Without dedicated hardware-level register structures, the system cannot function in real time."

"Which proves our point, gentlemen," Weber said, taking his seat. "The technology is bound to the silicon."

The Chairman stood, gathering his papers. "The Board will recess for sixty minutes to deliberate."

Private Dining Suite, Hotel Vier Jahreszeiten, Maximilianstraße, Munich

The private dining room on the top floor overlooked the historic rooftops of Munich, dark cherry paneling and a heavy crystal chandelier giving it a formal, quiet dignity.

Kaufmann sat at the end of the table, face tired, the sharp authority he'd shown in Frankfurt two weeks earlier muted by the afternoon's ruling. The EPO Opposition Board had unanimously rejected his petition, upholding Saraswati's BAC-1 patents across all thirty-two signatory states.

Victoria poured a small portion of sparkling water. Hirsch sat beside her, briefcase on the floor, a leather binder on the tablecloth.

"You fought a clean administrative action, Dr. Kaufmann," Hirsch said, breaking the silence. "The technical contribution doctrine is notoriously hard to navigate."

Kaufmann took a slow sip of red wine, setting the glass on his napkin.

"Save the professional compliments, Mr. Hirsch." His accent was heavy. "The board ruled that your silicon registers constitute a physical technical contribution. Fine. You have your legal wall. Now tell me why we're sitting in this room instead of receiving a formal infringement injunction from your solicitors."

Victoria set her glass down.

"Because Saraswati has no interest in destroying the West German consumer electronics industry, Dr. Kaufmann."

Kaufmann studied her for a second — not her suit, not her posture, just doing the math on how someone this young had out-maneuvered his entire legal department.

"You hold the master audio patents," he said, leaning back. "Every CD player, home receiver, and desktop monitor Grundig, Telefunken, or Philips builds for the 1991 market needs BAC-1 decoding hardware to play digital streams off The National Wire or the Austrian Master Sound archives."

"Which means," Hirsch said, sliding the binder across the table, "European industry needs a stable, long-term licensing framework."

Kaufmann didn't open it yet. "What are your terms?"

"A non-exclusive, multi-year manufacturing license," Victoria said.

His fingers paused on the edge of the binder. "Non-exclusive? You'll license the hardware architecture to European manufacturers?"

"We will. You keep your factories in Frankfurt, Hanover, and Eindhoven open. Grundig and Telefunken keep assembling standalone audio units, digital radio receivers, hi-fi monitors, under your own brand names."

"And the consideration?" He opened to Section 4.

"Two dollars forty per unit manufactured on the continent that incorporates BAC-1 decoding registers," Hirsch said. "Alongside full compliance with Saraswati's proprietary digital handshake protocol."

Kaufmann read it carefully. Two forty a unit was a manageable cost — Grundig and Telefunken could stay in business, keep their union labor, sell next-generation digital audio without facing billions in litigation.

Then he reached Section 8.

"The licensee agrees that all digital rights management keys, cryptographic handshakes, and network authentication APIs remain the exclusive property of Saraswati. No licensee shall attempt to alter, reverse-engineer, or bypass the digital handshake."

He looked up at Victoria.

He'd give up the low-margin factories — the union disputes, the plastic molding, the shipping logistics. Saraswati would keep total, automated control of the one thing that actually decided whether any of it made a sound.

"You leave us the hardware factories, Mademoiselle Sterling." Something almost like respect in it. "And you keep the tollgate."

"We believe in specialization, Dr. Kaufmann. Your consortium builds excellent physical machinery. We simply ensure the music plays."

Kaufmann reached into his jacket, pulled out a heavy black fountain pen, and signed.

"A pragmatic treaty. May your tollgate remain busy."

"It will, Herr Doctor," Victoria said, accepting the signed contract. "It will."

Private Client Suite, Hotel Vier Jahreszeiten, Munich

Night had cooled the suite, a breeze coming down off the Bavarian Alps. Victoria sat at the writing desk near the window, a cup of chamomile tea beside her portfolio, Munich's lights flickering five floors below.

She picked up the satellite receiver and dialed the direct line to Austin. It connected after two pulses.

"Victoria." Rudra's voice came through, unhurried as always.

"The Munich Accord is signed. Kaufmann and the Opposition Board accepted our technical contribution argument on the Bhairav-1 registers."

"And the royalty structure?"

"Two forty a unit, non-exclusive, across Grundig, Telefunken, Thomson, and Philips." She traced a line on her notepad with her pen. "The consortium keeps physical manufacturing. Saraswati keeps DRM handshake authority."

Over the line, the faint metallic sound of a coin turning between fingers clicked twice before he spoke.

"An excellent resolution. Kaufmann keeps his industrial dignity in Frankfurt, and we get BAC-1 established as the mandatory hardware standard for European consumer electronics."

"How is Texas this evening?" The boardroom formality had dropped out of her voice entirely.

"Hot. Humidity's up off the river. Dad and Vik are in the Vault finalizing the hardware override for Gable's Iron Curtain."

Victoria held the pen above her notepad without writing anything. Three days of legal maneuvering in Munich and Paris, and something about the unhurried certainty in his voice made the last of it unclench.

"Gable's MS-DOS update won't survive the silicon override, I presume?" There was warmth in it that hadn't been there in the boardroom.

"Won't survive the first memory-paging instruction it tries." Rudra said. "Gable's fighting silicon with software. He's already lost."

Victoria smiled, alone in the Munich room with nobody to see it. "William Gable will be thoroughly displeased when he gets the test telemetry from Redmond."

"He'll learn the boundary soon enough. Some men need the postmortem before they believe it."

There was a pause on the line — the kind he usually didn't leave. "When do you return to London?"

"Tomorrow morning. David and I close the final funding tranches at Sterling & Sons on Tuesday. And then... I fly back to Austin Thursday to review the crude oil options telemetry before the July clearing cycle."

"The positions are locked at eighteen thirty," Rudra said. "The market's completely calm."

"I know." She rotated her tea cup on its saucer. "I simply prefer reviewing the telemetry in the Vault."

"Safe travels, Victoria. I'll see you Thursday."

"Goodnight, Rudra."

The line went dead.

In the Vault, I set the receiver back on its cradle.

Robert walked in carrying a fresh binder stamped with the Mercer & Vance seal.

"David just faxed the signed Munich treaty from his hotel. The European patent challenge is officially dead."

"Kaufmann acted logically when presented with the silicon schematics, Dad." I stood.

"And OmniSoft?" Robert checked his notes. "Vik just ran the diagnostic simulation on the MS-DOS 5.0 update. The hardware register override worked flawlessly. Gable's Project Iron Curtain is completely impotent."

I picked up the coin and slipped it into my pocket.

"Then the perimeter is secure." I said. "Let's get some dinner, Dad. We have a long flight to London next week."
